The www.myrsvponline.com website is owned and operated by My RSVP Online as a product of Squigloo Multimedia Studio ABN 962 121 558 50. By using this web site and or by clicking on the "I have read and accept the Terms of Use" button, you signify your acceptance of the following Terms & Conditions.

1. Eligibility
Our services are available only to, and may only be used by, individuals who can form legally binding contracts under applicable law. Our services are not available to persons under 16 years of age.

2. Amendment to this agreement
We may amend the terms of this agreement from time to time, and we will let you know about these changes either by sending you an email to the email address you have registered with My RSVP Online.

3. Our service
My RSVP Online provides you with a guest website and account managing tools that include but are not limited to editing settings of your guest website, manage your guest RSVPs, create and manage a checklist and a budget. The account tools provided as part of this service are to be used privately. The guest website can be accessed by any guest you provide the address and password to. There is no limit on the number of guests which may reply using your guest website. However the guest website may only be used for one event.

4. Use of service
You agree to use this website for its intended purpose, namely to offer an event RSVP service where you can share information on your event to guests. You agree that you will not copy any content from this site without the express permission of My RSVP Online. You agree not to defame, harass, threaten or violate in any manner whatsoever, this includes other users of this web site or make comments on individual, corporations or other entities by using this site.

5. Registration, Accounts and Passwords
You agree to provide correct and accurate account information and that you do not deceive or misrepresent when registering such information. You agree that it is your responsibility to keep safe login and password information and that you agree to indemnify My RSVP Online for any loss arising form the loss or misuse of your registration information. You agree to notify My RSVP Online immediately should this information be breached or you believe it is breached.

6. Payment for service
All packages have a base price (Simple RSVP $150AUS, Pre-Made Template $250AUS and Custom made is price on application) and fee per option for the choice of Add-ons included in your product. The price of the package and add-ons will be invoiced to you. This price includes the setup and design of all features included in the package and add-ons included. You will be able to view the content of your website before paying however the RSVP service will not be activated until payment has been received. Payments can be made via direct transfer or through Pay Pal.

7. Content
My RSVP Online does not warrant information posted by its users. When you put content onto your Guest Website you warrant and represent that:

• your content does not contain material that defames or vilifies any person, people, races, religion or religious group and is not obscene, pornographic, indecent, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable;
• your content does not include malicious code, including but not limited to viruses, trojan horses, worms, time bombs, cancelbots, or any other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, data, or personal information;

If you believe any content in this site defames or has the potential to defame, you must notify My RSVP Online immediately. We will take the necessary steps to have this content removed, although make no undertaking to do this and that you agree that My RSVP Online is not responsible for the content and that any action must be taken directly with the user.

My RSVP Online reserves the right to remove any content from websites and offenders will have their site shut down with no compensation or refund.

8. Security of information
No data transmission over the Internet can be guaranteed as totally secure. We strive to protect such information, however we do not warrant and cannot ensure the security of any information that you transmit to us. Accordingly, any information that you transmit to us is transmitted at your own risk. Your account tools include backup facilities to help protect your information (See Exporting and restoring information).

9. Exporting and restoring information
Your account tools include the ability to export your Guest RSVP list, Checklist and Budget as a CSV (Comma separated values) file that can be opened using Microsoft Excel. If you wish to restore the information in your account to any of these files there is and administration fee of $30AUS to do so. My RSVP Online is not responsible for ensuring that CSV files will compatible with your computers software.

10. Privacy
You agree to use the information collected from your guests for the sole purpose of organising your event. You will not rent or sell your personal information to any third party. Doing so will result in the termination of your account.

Your privacy is very important to us. Please refer to our privacy policy for information about how we collect and use personal information.

11. Intellectual Property rights
This site includes copyright, trademarks, patents, designs, images, text, confidential information and layouts that are otherwise protected by law. Other than for the purposes of, and subject to the conditions prescribed under, the Australian Copyright Act 1968 (Cth) and similar legislation that applies in your location, and except as expressly authorized by this agreement, you may not in any form or by any means:

• use, adapt, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of this website; or
• commercialize any information, products or services obtained from any part of this website,

without our written permission.

12. Disclaimer

The use of this web site is at your sole risk and acknowledge that this web site, including but not limited to, content and services.

My RSVP Online does not warrant that this web site is compatible with you or your guests equipment or that this web site is free of errors or viruses or worms and is not liable for any damage you may suffer as a result of such destructive features. My RSVP Online will not accept responsibility or liability for any fault, inaccuracy, omission, delay or any other failure of this web site caused by your computer equipment.

You acknowledge that the My RSVP Online service or this website may be affected by outages, faults or delays. Such outages, faults or delays may be caused by factors, including technical difficulties with the performance or operation of our or another person’s software, equipment or systems, traffic or technical difficulties with the Internet or infrastructure failures.

We do not warrant that any of your guest's RSVP submissions to your service will be protected against loss, or misuse.

We do not accept responsibility for any loss or damage, however caused (including through negligence), that you may directly or indirectly suffer in connection with your use of this website or any linked website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this website.

13. Liability
Any liability of My RSVP Online in connection with any breach of goods or services supplied to you by My RSVP Online (other than a condition or warranty implied by legislation and to the maximum extent permitted by law) will, the discretion of My RSVP Online be limited to:

a. If the condition relates to goods, the replacement of the goods or the supply of equivalent goods; and
b. If the condition relates to services, the supplying of the services.

In no event will My RSVP Online be liable to you in excess of any amount payable by you for any goods or services purchased on this web site.

14. Governing Laws
These Terms and Conditions are governed and construed in accordance with the laws of Victoria, Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria and any courts which have jurisdiction to hear appeals from those courts and waives any right to object to any proceedings being brought in those courts.

This site may be accessed throughout Australia and overseas. My RSVP Online makes no representations that the content of this site complies with the laws (including intellectual property laws) of any country outside Australia. If you access this site from outside Australia, you do so at your own risk and are responsible for complying with the laws in the place where you access the site.

15. Third Party Links
All links to external websites for the purpose of advertising and obtaining further information are correct at time of publication and are designed to only transport our visitors to legitimate websites free of offensive content. You agree that dealings with any third party web sites are between you and the third party and that My RSVP Online will have no responsibility or liability associated with any such dealings.

16. Indemnity
You agree to indemnify, defend and hold us, our officers, directors, employees, contractors, agents and representatives harmless from and against any and all claims, damages, losses, liabilities, costs (including reasonable legal fees) or other expenses that arise directly or indirectly out of or from for any misuse of this site or breaching this agreement or the content policy. This indemnity will be applicable without regard to the negligence of any party, including any indemnified person.

17. Rights to Terminate Use
You agree that My RSVP Online has the right to terminate your account if you are found to be in breach of the Terms and Conditions set out in this document without a full refund or compensation. If terminated by My RSVP Online, you agree that you will not start another account unless expressly agreed with My RSVP Online. Your account will expire 2 weeks after the day of your event, as specified in your application form, unless an individual expiry agreement is made.

18. General
Information on this Web site may contain technical inaccuracies or typographical errors. You accept that My RSVP Online has the right to change the content or technical specifications of any aspect of this web site at any time at My RSVP Online's sole discretion.

If any provision of the Terms of Use is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the other provisions of the Terms of Use will remain in force.
